Terms & Conditions

These Terms and Conditions (“Agreement”) govern your access to and use of the services, products, and websites provided by Wicked Robot Development (“Wicked Robot Development”, “we”, “us”, or “our”), including wickedrobot.dev and any control panels, APIs, and support portals (collectively, the “Services”). By registering for an account, ordering Services, accessing your account, or otherwise using the Services, you agree to be bound by this Agreement. If you do not agree, do not use or access the Services.

Definitions

Account: the user account established to access Services.
Customer, You, Your: the person or entity that orders or uses Services.
Services: hosting, domain-related services, email, control panel access, backups, support, and any other products offered by Wicked Robot Development.
Acceptable Use Policy (AUP): Wicked Robot Development’s policy describing prohibited conduct and content.
Affiliate / Subprocessor: third parties engaged by Wicked Robot Development to provide infrastructure, processing, or other services.

Scope of Services

Wicked Robot Development provides managed Linux cloud shared hosting and related services as described on our website and in your order confirmation. Specific feature sets, resource allocations, limits, and options (e.g., CPU, memory, disk, backups, software stacks) are defined by the plan you purchase and may be changed by us with notice when necessary to maintain service quality or respond to security or operational needs.

Account Registration, Eligibility, & Verification

You represent and warrant that you are at least 16 years old and have legal capacity to enter into this Agreement.
You agree to provide accurate, current, and complete information when creating an Account and to keep that information updated.
You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your Account. You must notify support immediately of any unauthorized access.
Wicked Robot Development may request identity verification or additional information to activate, modify, or continue service provision. Failure to verify when requested may result in suspension or termination.

Orders, Fees, Billing, & Payment

All Services are billed in advance according to the billing cycle you select at purchase. Recurring services will automatically renew using the payment method on file unless canceled prior to renewal.
You authorize Wicked Robot Development to charge the payment method on file for all fees, taxes, and charges associated with your Account. You are responsible for any taxes applicable to your purchases.
We may suspend or terminate Services for non‑payment. You remain responsible for fees incurred prior to suspension or termination.
Refunds are governed by our Refund Policy posted on the site. Refunds may be denied if we determine fraud, abuse, or breach of this Agreement. Chargebacks must be disputed through our billing support before being filed with your payment provider.

Service Use, Resource Limits, & Fair Use

Your Services are subject to resource limits and usage restrictions described in plan details, plus fair use policies. Excessive or abusive usage may result in throttling, suspension, or requirement to upgrade to a higher tier.
You must not use Services in a way that overloads or degrades shared infrastructure, interferes with other customers, or circumvents resource controls. Examples include but are not limited to heavy continuous CPU, memory, or I/O consumption, mining, running unauthorized persistent background processes, or hosting high‑volume streaming or CDN workloads on shared plans.
Where a plan or feature explicitly lists “unlimited bandwidth” or “unlimited traffic,” the unlimited bandwidth provision applies to traffic delivered through the network infrastructure that supports that plan and is subject to our acceptable use, fair usage, and anti‑abuse policies described.

Acceptable Use & Prohibited Activities

You must comply with our Acceptable Use Policy (AUP) and all applicable laws. Prohibited activities include hosting illegal content, operating phishing, distributing malware, sending spam, launching attacks, copyright infringement, and other activities that harm our network, reputation, or customers.
We reserve the right to investigate suspected violations, suspend or terminate Services, and disclose information to law enforcement or rights holders where required by law.

Domain Registrations, Transfers, & WHOIS

Domain registrations performed through our platform are subject to registrar, registry, and ICANN policies or other applicable registry rules. You are responsible for ensuring the accuracy of WHOIS and contact information.
Domain renewals, transfers, and deletions follow registrar-specific rules; fees and timelines vary. Wicked Robot Development is not responsible for loss of domain if proper renewal processes are not followed by you.
Privacy or WHOIS protection services are offered where available and are subject to separate terms.

Backups, Data Retention, & Customer Responsibility

Where backups are provided, they are a convenience and disaster recovery aid. Backups may have retention limits, snapshot frequency, or recovery windows as described in plan details. You are solely responsible for maintaining your own copies of critical data and verifying backups meet your needs.
Wicked Robot Development may retain account and service-related data as required for billing, legal obligations, abuse investigations, or fraud prevention.

Security, Monitoring, & Abuse Response

We implement technical and administrative safeguards appropriate to the Services, including network monitoring, firewalls, malware scanning, and intrusion detection. You must take reasonable measures to secure your applications, credentials, and content.
In the event of abuse, compromise, or security incident involving your Account, we may suspend or isolate impacted services, reset credentials, or apply remediation steps to protect the platform. Where warranted, we will notify you with available details and recommended next steps.

Support, Maintenance, & Service Levels

We provide support per the level included in your plan. Support includes ticketed responses, self‑help resources, and any premium options you may purchase. Support response times are not guaranteed unless you have purchased a premium support tier with a Service Level Agreement (SLA).
We may schedule maintenance and upgrades. We will use commercially reasonable efforts to provide advance notice for planned maintenance that materially impacts service. Emergency maintenance may occur without notice to protect security or platform stability.

Intellectual Property Rights

You retain ownership of content you upload or host, subject to the rights you grant us to provide Services (storage, backup, transmission, caching, and technical processing).
Wicked Robot Development and its licensors retain ownership of all platform, software, trademarks, and intellectual property used to provide the Services. You may not reverse engineer, copy, or create derivative works of our proprietary systems except as expressly permitted.

License & Usage Rights

By uploading content and using the Services you grant Wicked Robot Development a limited, non‑exclusive, worldwide, royalty‑free license to use, reproduce, store, and transmit that content solely as necessary to provide the Services (including backups, migrations, and technical support).
You represent that you have all necessary rights and consents to host and distribute content and that your content does not violate third‑party rights.

Third-Party Services & Integrations

Wicked Robot Development may integrate with third‑party services (payment processors, domain registries, analytics, CDNs, plugins). Those third parties have their own terms and privacy practices; we are not responsible for their actions or policies. Use of third‑party add‑ons may require acceptance of separate agreements.

Suspension & Termination

We may suspend, limit, or terminate Services if you breach this Agreement, fail to pay, violate the AUP, engage in abusive behavior, or for other operational reasons. Suspension may be temporary or permanent.
On termination we may delete or irreversibly remove account data in accordance with our retention schedule. We are not liable for any loss of data after deletion. It is your responsibility to export or retain data prior to cancellation or termination.

Warranties, Disclaimers, & No Guarantee of Uptime

Wicked Robot Development provides Services on an “AS IS” and “AS AVAILABLE” basis without express or implied warranties. We disclaim all implied warranties to the fullest extent permitted by law including merchantability, fitness for a particular purpose, and non‑infringement.
While we aim for high availability, we do not guarantee uninterrupted service unless an SLA specifically applies to your contract.

Limitation of Liability

To the maximum extent permitted by law, Wicked Robot Development’s aggregate liability for direct damages shall not exceed the lesser of (a) the total fees paid to Wicked Robot by you in the 12 months preceding the claim, or (b) the maximum amount allowed by applicable law.
Wicked Robot Development is not liable for indirect, incidental, special, exemplary, or consequential damages including lost profits, data loss, or business interruption even if advised of the possibility of such damages.

Indemnification

You agree to indemnify, defend, and hold harmless Wicked Robot Development, its officers, directors, employees, agents, and affiliates from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the Services; (b) your violation of this Agreement; (c) your infringement of third‑party rights; or (d) your negligence or willful misconduct.

Dispute Resolution, Governing Law, & Jurisdiction

This Agreement is governed by the laws of the state or jurisdiction where Wicked Robot Development is headquartered, without regard to conflict of law principles.
Except where prohibited by law, you agree that disputes will be brought exclusively in the state and federal courts located in that jurisdiction and you consent to personal jurisdiction and venue there.
If any provision of this Agreement is found invalid or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in full force.

Notices

We may provide notices by email to the address on file, via the control panel, or by posting on our website. You consent to receive electronic notices. Notices to Wicked Robot Development must be sent to support@wickedrobot.dev or as otherwise specified on our site.

Changes to Terms

We may modify this Agreement at any time. Material changes will be posted on wickedrobot.dev with a revised effective date and, where required by law, we will provide notice to account holders by email. Continued use of the Services after changes constitutes acceptance of the updated Agreement.

Miscellaneous

No waiver of any term will be effective unless in writing and signed by an authorized representative.
This Agreement, together with any order forms, service level agreements, and policies referenced herein (including our Privacy Policy and AUP), constitutes the entire agreement between you and Wicked Robot Development concerning the Services and supersedes prior agreements.

Acknowledgment

By using Wicked Robot services, you acknowledge that some features may be provided by third parties and that the third parties’ terms, policies, and feature sets apply to those components.
